do you need a license for them? and if my husb working in an area w/ no cell signal about 38 miles away from me - would I be able to talk to him just for an emergency use?

Yes, you need a GMRS license which is $70 and covers you and your extended family for 10 years. You more than likely will not get 38 miles of range. That type of range can only be achieved over open water or mountain top to mountain top. Any obstructions will greatly decrease your range.
